Asset Agreement

For IT equipment:

 MassBay Community College (MBCC) may provide computer equipment such as a laptop computer, tablet and/or mobile device (“Equipment”) to certain employees for the purpose of performing job related tasks specific to academic instruction, research, business operations and emergency management. All employees receiving equipment must abide by this agreement.

 Employee Responsibilities

1.      Equipment may be assigned to employees in order to perform duties pertaining to the business of the College. Equipment shall not be used by non-employees or for non-College related purposes.

2.      Equipment will be loaded with a standard suite of approved software and security applications installed by the College.  Employees may not alter, modify or disable the equipment or its software in any manner.

3.      Employees are responsible for all data stored on the hard drive of the device in terms of security and back up. The Office of Information Technology recommends saving all files to the Google drive of the network for automatic backup.

4.      All use of the equipment shall adhere to the College’s Computer and Network Usage Policy.

5.      Employees who have permission to work with Personally Identifiable Information (PII) Data, including student record information, are prohibited from downloading files containing such information to the local hard drive of the equipment.

6.      It is the employee’s responsibility to deliver the equipment to a designated location for updates upon notification from the Office of Information Technology staff.

7.      All equipment is owned by the College and is covered by a standard, limited warranty, which only covers replacement of defective hardware parts. This warranty does not cover drops, falls, electrical surges, liquids spilled on the units, fire damage, intentional damage, normal wear and tear, lost parts (power units) or consumables (batteries).  In the event of damage or malfunction to the equipment, it is the employee’s responsibility to report the incident within two (2) business days to his/her supervisor and return the equipment to the Office of Information Technology for repair or replacement.  An employee may be responsible for repair or replacement costs if said costs are not covered by the limited warranty and are the result of misuse or abuse.

8.      In the case of theft of the equipment, the employee shall immediately notify his/her supervisor and the Office of Information Technology.  Further, the employee must file a police report and provide a copy of the report to his/her supervisor. 

9.      The equipment shall not leave the U.S., except on approved college related business.

10.  In the event the employee’s employment with the College ends, the employee shall return the equipment and all associated peripheral items (e.g. charger cables and adapters) to his/her supervisor on a date specified or by the employee’s last day of employment. If the employee fails to return the equipment, the employee may be liable for the replacement cost of the equipment. The employee shall clear all personal information including passcodes, Apple IDs, etc., from equipment before its return.

11.  An employee will be in default of this Agreement if he/she: (i) fails to care for and maintain the condition of the equipment; (ii) misuses or abuses the equipment; (iii) loans or makes any other transfer of the equipment; or (iv) violates any of the other terms or conditions of this Agreement.  A default may result in criminal prosecution or civil liability, including liability for the replacement cost of the equipment. In addition, upon the employee’s default, the College has the right to take immediate possession of the equipment.


College Responsibilities

1.      If necessary, the College shall equip all computers with encryption protections and provide periodic security protection up-dates as required

3.      The Office of Information Technology will provide replacement equipment, if one is available, in the event of a need for repair of the assigned equipment.

4.      The Office of Information Technology is responsible for ensuring that the equipment is loaded with the standard selection of software and security applications and shall perform periodic updates as needed.

5.      The College is not responsible or accountable to the employee for any loss, damage, claim, demand, liability, cost or expense of any nature or kind, including indirect, special or consequential damages, arising directly or indirectly out of the employee’s possession, use, control or operation of the equipment, including those resulting from the inadequacy of the equipment, or the results obtained from it, or any defect in it, or from mechanical failures of the equipment, loss of data, or from interruption of information technology use while such failures are being remedied or while other repairs and/or maintenance are being performed.
